Wisconsin Carry funds legal defense in Kenosha County CCW case

 

ATTN Kenosha area folks: Wisconsin Carry, Inc. is funding the legal defense for a Wisconsin resident who was charged with a violation of 941.23 (carry concealed weapon)

Guy is a truck driver. In June 2016 he pulled into the Kenosha weigh station on I-94 with his semi. He had an openly carried handgun on the floor of his cab. (his cab doesn't have a passenger seat)

After passing weight he was asked to pull around to the lot and meet the Trooper behind his rig for an inspection. Before he was able to exit his truck to meet the Trooper, the Trooper approached from the passenger side, opened the passenger door and stepped up to the cab and observed the openly carried handgun.

Guy does not have a concealed carry license. The Trooper subsequently cited him for CCW violation and the Kenosha County DA filed charges.

Wisconsin Carry believes that, because new legislation trumps OLD case-law, changes to Wisconsin law with Act 35 and the vehicle transport statutes have made it LEGAL to carry a weapon in a vehicle (open or concealed) WITHOUT a concealed carry permit. WE ARE AWARE some DA's do not agree with our conclusion. (reminder government never willingly gives up power)

Guy is a law abiding citizen with no criminal or misdemeanor record. Squeaky clean. The Kenosha DA didn't care.

We have carjackers in Milwaukee getting slapped on the wrist while DA's in other counties throw the book at law abiding citizens exercising constitutional rights.

IF YOU ARE FREE ON MONDAY MORNING November 14th 2016. Guy's case goes to trial in Kenosha at the Kenosha County Courthouse. Scheduled to start at 9AM

Wisconsin Carry intends to push this case as far as possible in order to establish a precedent setting decision that you do NOT need a concealed carry license to have a loaded handgun anywhere in your vehicle (except in school zones)
